Course Syllabus

Abstract

The environmental law course provides a systematic understanding of the legal regulation of nature management and environmental protection in Russia, as well as its relationship to other areas of regulation (in particular, land and urban planning regulation). The course also examines environmental law through the lens of legal regulation of sustainable development and ESG. At the end of the course, the student will know the main institutions of environmental law, the place of environmental law in the system of branches of law (civil, corporate, administrative, energy and others), regulatory and law enforcement acts in this area, as well as trends in practice. As a result of mastering the course, the student will strengthen the following skills: – search and system analysis of information necessary for solving theoretical and practical problems in the field of environmental law – problem statement and development of solutions to legal incidents in the field of environmental law

Learning Objectives

• to form students' understanding of the system of regulatory acts in the field of nature management and environmental protection;
• to study the specifics of the implementation in Russian law enforcement practice of certain institutions of nature management and environmental protection;
• to consider doctrinal approaches in private law and public law science to solving legal problems of nature management and environmental protection;
• develop information retrieval and analysis skills to solve problems in the field of nature management and environmental protection;
• learn how to resolve legal issues and form a position on environmental management and environmental protection.

Expected Learning Outcomes

• The student knows the subject, the system and methods of environmental law, public and private law elements of environmental law, sources of environmental law, the role of non-normative legal acts and law enforcement practice.
• The student knows the basics of legal regulation of regulation in the field of environmental protection, licensing activities in the field of nature management and environmental protection
• The student knows the basics of legal regulation of licensing activities in the field of nature management and environmental protection
• The student knows the basics of economic regulation in the field of environmental protection.
• The student knows the basics of environmental control and environmental monitoring, knows the main provisions of the CND reform, as well as the main directions of digitalization of the sphere of environmental management and environmental protection.
• The student knows the basics of environmental responsibility and responsibility for environmental offenses. The student knows about the relationship between environmental responsibility, ESG and sustainable development. The student knows the basics of tort liability for environmental offenses, knows the basics of legal regulation of objects of accumulated harm, environmental protection.
• The student knows the basics of legal regulation of a special part of environmental law.

Assessment Elements

• Test
  The control work is carried out in the form of solving the problem. The task is a description of the situation / problem with three questions. Solving the problem involves a detailed answer to the questions posed, including identifying the legal problem, analyzing and evaluating relevant regulations and judicial practice, and independently formulating conclusions based on knowledge of the basics of legal regulation. The answer should demonstrate the student's ability to identify a key legal issue, critically comprehend it, and logically consistently state their reasoning, while using the provisions of regulatory legal acts and judicial practice. In the process of solving the problem, you can use the legal reference system "Consultant Plus". Use of services with generative artificial intelligence (Deep Seek, ChatGPT, etc.), other printed reference materials, including lecture notes, regulations, and other technical devices is not allowed. The task takes 45 minutes to complete. The maximum score for the work is 10.
• Work at seminars
  Work at seminars involves the solution of problems and demonstration of the prepared solutions of the proposed task participation in the discussions.
• Exam
  The exam is conducted in the form of problem solving. The task is a description of the situation / problem with three questions. Interim Assessment

  Orez = Test * 0,2 + Work at seminars * 0,2 + 0,6 * Exam, Current and final control tasks can be performed on the LMS platform, using the ZOOM, MSTeams, and Webinar video conferencing platforms. During the tasks of the current and final control, the student must ensure that there is a stable Internet connection and a working (turned on) video camera. Failure to meet the specified conditions is equivalent to failure to show up for the control element. In the event that when checking students ' written works, including exam papers, it is revealed that the text of the answer completely or partially coincides with different students, and this coincidence is not caused by quoting the norms of the law or judicial practice of higher courts, all students who have a match are given a score of 0 for their work, without finding out the reasons for this coincidence. The duration of execution of each control element set by this program includes the time of writing the control element and the time of its delivery when writing in the paper version, the time of its loading when executing in the SmartLMS systemSmartLMS.
